Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of kavello.app and its AI image generation and editing, video generation, prompt templates, image showcases, account, payment, and related services (the “Service”). The Service is operated by Hong Li, an individual operator based in China (“Kavello,” “we,” “us,” or “our”).

By accessing the Service or continuing through sign-in or registration, you agree to these Terms and our Privacy Policy, and you confirm that you are at least 18 years old. If you do not agree, do not use the Service.

1. Eligibility and availability

You must be legally able to enter into these Terms and use the Service where you live. The Service is not offered where prohibited by law or where required infrastructure, AI providers, or payment methods are unavailable. You may not evade sanctions, export, geographic, or availability controls, including through a VPN or false location information.

2. Accounts

You must provide accurate information, keep your account secure, and promptly notify support@kavello.app of unauthorized access. You are responsible for activity under your account except to the extent caused by Kavello or otherwise provided by mandatory law. You may not share, sell, or transfer an account without our written permission.

3. The Service and AI outputs

Kavello lets users submit prompts and files to supported AI models and receive generated content. Models, providers, features, queues, limits, output formats, generation times, and availability may change.

AI outputs can be inaccurate, incomplete, unexpected, offensive, similar to other outputs, or unsuitable for a particular purpose. We do not guarantee output accuracy, originality, uniqueness, copyrightability, non-infringement, quality, fitness, availability, or that an output will meet your expectations. You must review outputs before relying on or publishing them.

You may use outputs, including commercially, only to the extent permitted by applicable law, these Terms, and applicable provider terms. Kavello does not grant rights in third-party materials, model software, trademarks, likenesses, voices, or other protected subject matter.

4. Your content and licence to Kavello

As between you and Kavello, you retain the rights you hold in content you submit and outputs you receive. You are responsible for obtaining all permissions, notices, and lawful bases needed to upload, process, generate, store, publish, or commercialize that content.

You grant Kavello a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to host, copy, process, transmit, display to you, adapt technically, moderate, secure, troubleshoot, and otherwise use your content as necessary to operate, maintain, improve, and promote the Service. This licence lasts only as long as reasonably necessary for those purposes, subject to lawful retention and backup periods. Private content is not made public merely because of this licence. Image generation defaults to Private. Selecting Public permits display of the output image, prompt, derived title, tags, and publication information in Image Showcases. Private content is not used in public promotion without separate permission. Deleting the image-history record withdraws its associated public showcase; previously downloaded or cached copies and unexpired short-lived links may remain available. Retained-file deletion requests follow the Privacy Policy.

Feedback you voluntarily provide may be used without restriction or compensation, provided we do not identify you publicly without permission.

Prompt templates are creative starting points, not guarantees of identity preservation, accurate historical reproduction, or a particular result. For portraits, couple or family photos, obtain the permissions needed from the people depicted and, where applicable, their lawful guardians. Do not present stylized or synthetic outputs as authentic historical evidence.

5. Prohibited content and conduct

Our Acceptable Use Policy forms part of these Terms and applies to prompts, uploads, and generated outputs.

You must not use the Service to create, upload, request, distribute, or facilitate:

• NSFW, pornographic, sexually explicit, or sexually suggestive content, including content involving consenting adults;
• illegal activity, fraud, scams, phishing, malware, evasion, or instructions that create serious harm;
• content that infringes copyright, trademark, privacy, publicity, confidentiality, or other rights;
• child sexual abuse material, sexual content involving minors, grooming, or exploitation of minors;
• non-consensual intimate imagery, sexual exploitation, coercion, or threats;
• deceptive impersonation, identity abuse, forged evidence, or misleading synthetic media intended to harm or defraud;
• hateful abuse, targeted harassment, credible threats, or encouragement of violence;
• unauthorized face, voice, likeness, or personal-data use;
• attempts to bypass safety systems, access restrictions, usage limits, payment controls, or security protections;
• scraping, reverse engineering, automated access, resale, or interference beyond what applicable law expressly permits; or
• any other content or conduct that creates material legal, safety, security, or service-integrity risk.

We may automatically or manually review, block, remove, or restrict content and accounts to enforce these rules. Safety decisions may be imperfect; contact support if you believe a technical error occurred.

6. Copyright and rights complaints

If you believe content available through Kavello infringes your rights, email support@kavello.app with your identity, the work or right involved, the relevant Kavello content or URL, a good-faith explanation, and your contact information. We may request verification, remove or restrict material, preserve evidence, notify the user where appropriate, or suspend repeat or serious violators.

This is a simplified rights-reporting process and is not a representation that Kavello has adopted any particular statutory safe-harbour programme.

7. Plans, payments, and taxes

Prices are shown in USD unless checkout states otherwise. Applicable taxes may be added. Your bank or payment provider may impose currency-conversion or other fees. The checkout page will show the final amount before you pay.

Payments may be handled by Stripe, PayPal, Waffo, or Creem, depending on the method offered at checkout. Their terms and privacy notices also apply to their processing.

You authorize the disclosed processor to charge the selected payment method for purchases and recurring subscriptions. You must keep billing information current and may not initiate fraudulent payments or disputes.

8. Subscriptions and automatic renewal

A subscription automatically renews for the same billing interval until cancelled. Before purchase, checkout will identify the price, billing interval, taxes, renewal, and cancellation terms. We send a confirmation after purchase.

We intend to send a renewal reminder 7 days before each monthly charge and 30 and 7 days before each annual charge. A reminder is informational and does not replace your responsibility to cancel before renewal. There is currently no free trial.

You may cancel through User Center → Subscription → Cancel, or contact support if self-service is unavailable. Cancellation takes effect at the end of the current paid billing period. You keep access through that period, no further renewal charge is made, and no prorated refund is provided except where our Refund Policy or mandatory law requires it.

If renewal payment fails, we may notify you and the processor may retry. No new subscription credits are granted until payment succeeds. We may provide a 3-day account grace period before cancelling the subscription; account history remains available unless the account is separately restricted or deleted.

Version 1 does not support changing a subscription in the middle of a billing period. Cancel the existing subscription and select a new plan after the current period. A second active subscription may be blocked, but eligible one-time credit packs may still be purchased.

We will give at least 30 days' notice before a price change affects a future renewal, where legally required. You may cancel before the new price applies.

9. Credits

Credits are limited, non-transferable Service units with no cash value.

• Monthly and annual subscription credits expire at the end of their applicable billing period and do not roll over.
• One-time top-up credits do not expire while the account remains active.
• Gift or promotional credit validity is configured per grant and shown when granted. A later change does not retroactively shorten an existing displayed validity period. A grant displayed without an expiry remains available while the account is active.
• Credits with the earliest expiry are consumed first. Credits with the same expiry are normally consumed in this order: gift, subscription, then top-up.
• Credits returned after a failed generation expire on the later of their original expiry and 3 days after return.

Your in-app balance and credit history show available amounts and expiry information. Closing or deleting an account ends access to unused credits unless mandatory law requires otherwise.

10. Failed generations

If no usable output is produced because of a confirmed Kavello, AI-provider, queue, timeout, or post-processing failure, charged or reserved credits are normally returned automatically. A safety rejection that produces no result is not charged, or reserved credits are returned. Provider-cancelled and empty-result tasks are treated similarly.

A successfully generated and accessible output is not eligible for a credit return solely because you dislike the result. Contact support for a confirmed major technical problem. Returned credits are Service credits, not a cash refund, unless the Refund Policy or mandatory law states otherwise.

11. Refunds

Refund eligibility, time limits, exceptions, processing time, and cancellation treatment are set out in our Refund Policy, which forms part of these Terms. Nothing in these Terms limits non-waivable consumer rights.

12. Service changes, suspension, and termination

We may add, change, limit, suspend, or discontinue models, providers, features, or the Service. We do not promise permanent model availability, uninterrupted uptime, a fixed generation speed, or unlimited use. Where practicable, we will notify you of a material change that substantially impairs a paid Service.

We may restrict, suspend, or terminate access for a violation of these Terms, fraud, abuse, security risk, non-payment, unlawful activity, or legal requirement. Urgent safety, fraud, security, or legal action may occur without advance notice. Fees and unused credits are normally non-refundable after enforcement, except under the Refund Policy or mandatory law.

You may stop using the Service at any time and may request account deletion under the Privacy Policy. Sections that by their nature should survive—including payment, intellectual property, disclaimers, liability, indemnity, disputes, and lawful retention—continue after termination.

13. Third-party services and marks

The Service depends on third-party AI, hosting, authentication, analytics, email, and payment services. We are not responsible for third-party services outside our reasonable control. Provider and model names identify compatibility and do not imply sponsorship, endorsement, partnership, or ownership. Third-party marks belong to their respective owners.

14. Disclaimers

To the maximum extent permitted by law, the Service and outputs are provided “as is” and “as available.” Kavello disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain exclusions, so they apply only to the lawful extent.

15. Limitation of liability

To the maximum extent permitted by law, Kavello is not liable for indirect, incidental, special, exemplary, punitive, or consequential losses; lost profits, revenue, data, opportunity, reputation, or business interruption; or losses caused by your content, reliance on AI outputs, third-party services, or events outside our reasonable control.

These exclusions do not apply to liability that cannot lawfully be excluded or limited, including applicable liability for fraud, wilful misconduct, gross negligence, death or personal injury, or non-waivable consumer rights. These Terms do not state an aggregate monetary liability cap.

16. Indemnity

To the extent permitted by law, you will defend, indemnify, and hold Kavello harmless from third-party claims, losses, and reasonable costs arising from your unlawful or fraudulent conduct, infringement of third-party rights, or other serious violation of these Terms. This does not apply to the extent a claim was caused by Kavello's own unlawful conduct or fault.

17. Resolving concerns

Please contact support@kavello.app first so we can try to resolve a concern informally. Nothing in these Terms imposes binding arbitration, an exclusive court, or a waiver of rights you cannot lawfully waive. Applicable law and competent forums are determined under otherwise applicable legal rules.

18. Changes to these Terms

We may update these Terms as the Service evolves. We will post the new version and date. Material changes to price or renewal, data use, content licence, or user rights receive at least 30 days' email or in-app notice where practicable and legally required. Urgent legal, fraud, or security changes may take effect immediately. If you do not accept an update, stop using the Service and cancel before the change applies.

If the English Terms conflict with a translation, the English version controls to the extent permitted by law. Mandatory rights under applicable law remain unaffected.
